Welcome to Ejarmate, a roommate and shared-housing marketplace platform designed to connect tenants with compatible roommates and landlords in Saudi Arabia. By accessing, browsing, or using our website, mobile application, and all related services (collectively, the "Platform"), you agree to comply with and be bound by the following Terms of Service ("TOS"). These terms govern your use of Ejarmate, including all features, functionality, and services provided.
If you do not agree with these terms and conditions, you must immediately cease using the Platform. Your continued use of Ejarmate constitutes your acceptance of these Terms of Service in their entirety. We reserve the right to modify these terms at any time, and your continued use of the Platform indicates your acceptance of any updated terms.
1. General Conditions
Service Availability and "As Is" Basis
Ejarmate provides its services on an "as is" and "as available" basis without warranties of any kind, either express or implied. While we strive to maintain continuous availability of the Platform, we do not guarantee that the Platform will be available at all times or without interruption. We are not liable for any temporary or permanent unavailability of services due to technical issues, maintenance, or circumstances beyond our reasonable control.
Eligibility
To use Ejarmate, you must:
- Be at least 18 years of age (or the legal age of majority in your jurisdiction)
- Be a resident of Saudi Arabia or an authorized user within the Kingdom
- Have the legal capacity to enter into binding contracts
- Provide accurate, complete, and truthful information during registration
- Comply with all applicable Saudi Arabian laws and regulations
User Responsibilities
- Maintaining the confidentiality of your account credentials (username and password)
- All activities and transactions conducted under your account
- Notifying us immediately of any unauthorized access or security breach
- Your compliance with all applicable laws and regulations
- Any harm, loss, or damage arising from your use of the Platform
Accuracy of Information
You represent and warrant that all information you provide when registering for an account and using the Platform is accurate, current, and complete. You agree to update your information promptly if any details change. False or misleading information may result in immediate suspension or termination of your account.
Account Security
You must implement reasonable security practices to protect your account, including using strong passwords and logging out after each session. Ejarmate is not liable for any loss or damage resulting from your failure to maintain account security.
2. User Accounts
Account Registration
To create an account on Ejarmate, you must:
- Complete the registration form with accurate personal information
- Verify your email address and phone number
- Complete identity verification through the government-authorized Absher system (for both tenants and landlords)
- Provide employment confirmation or verification documents (for employment verification)
- Accept these Terms of Service and our Privacy Policy
Account Verification
Ejarmate requires identity verification for all users to ensure platform safety and prevent fraud. The verification process includes:
- Government-issued ID verification through Absher
- Employment verification for employment-based profiles (if applicable)
- Reference checks from previous landlords or roommates
- Contact information verification
Account Management
- Maintaining accurate and up-to-date profile information
- Updating your preferences and compatibility quiz responses as needed
- Managing your privacy settings and communication preferences
- Regularly reviewing your account activity for suspicious behavior
Account Suspension and Termination
Ejarmate reserves the right to suspend or terminate your account at any time, with or without notice, if:
- You violate these Terms of Service or our Privacy Policy
- You engage in fraudulent, illegal, or harmful activities
- You violate the Acceptable Use Policy (Section 3)
- You provide false or misleading information
- You breach the safety and community standards of the Platform
- You fail to complete mandatory verification requirements
- You engage in harassment, discrimination, or abusive behavior
- Your account is dormant for an extended period
Account Deletion and Data Retention
You may request deletion of your account at any time through your account settings or by contacting us. Upon deletion:
- Your profile will be removed from public view
- Your personal information will be deleted in accordance with our Privacy Policy
- Transaction records and communication history may be retained for legal and fraud prevention purposes
- Certain data may be retained as required by Saudi Arabian law
Account deletion is permanent and cannot be reversed.
Multiple Accounts
Users are permitted to maintain only one active account. Creating multiple accounts is prohibited and may result in termination of all associated accounts. Ejarmate reserves the right to merge duplicate accounts or take other actions to prevent account abuse.
3. Acceptable Use Policy
Prohibited Activities
You agree not to use Ejarmate for any illegal, fraudulent, harmful, or unethical purposes, including but not limited to:
Illegal Activities
- Any activities that violate Saudi Arabian laws or international laws
- Human trafficking, exploitation, or forced labor
- Drug trafficking or illegal substance distribution
- Money laundering or financial fraud
- Terrorism-related activities
Harassment and Abuse
- Harassment, bullying, threats, or intimidation of other users
- Discrimination based on race, ethnicity, religion, gender, sexual orientation, or national origin
- Sexual harassment or inappropriate sexual content
- Doxxing or sharing others' personal information without consent
- Hate speech or inflammatory language
Fraudulent and Deceptive Practices
- Impersonating another person or misrepresenting your identity
- Creating fake profiles or using false information
- Fraudulent property listings or rental scams
- Misrepresenting property conditions, features, or availability
- Phishing, identity theft, or social engineering attacks
- Engaging in "romance scams" or relationship-based fraud
Intellectual Property Violations
- Uploading copyrighted images, videos, or content without permission
- Plagiarizing content from other users or sources
- Violating trademarks or brand rights
- Unauthorized use of others' photos or personal images
Platform Abuse
- Attempting to hack, disrupt, or interfere with Platform functionality
- Uploading malware, viruses, or harmful code
- Spamming, mass messaging, or automated content distribution
- Scraping, crawling, or extracting data from the Platform without authorization
- Reverse engineering or attempting to access the Platform's proprietary technology
- Manipulation of the matching algorithm or rating systems
Illegal Content
- Sharing explicit, pornographic, or obscene content
- Distributing content depicting violence, abuse, or harm
- Sharing illegal drugs, weapons, or controlled substances
- Any content that exploits minors or promotes child abuse
Unauthorized Commercial Activity
- Using Ejarmate for unauthorized business, advertising, or marketing
- Attempting to redirect users to external platforms
- Soliciting transactions outside the Ejarmate platform to avoid fees or oversight
- Operating as an unlicensed broker or intermediary without proper authorization
Violations and Consequences
- Immediate Suspension: Temporary restriction from platform access
- Permanent Termination: Permanent removal from the Platform with forfeiture of all account data
- Legal Action: Referral to Saudi Arabian law enforcement authorities
- Monetary Liability: Claims for damages, fraud, or misuse of the Platform
- Public Notice: In serious cases, public notification to other users
Ejarmate has the sole discretion to determine whether a violation has occurred and what action to take. Terminated users may not create new accounts.
Reporting Violations
Users are encouraged to report any violations of this Acceptable Use Policy by:
- Using the "Report" feature within the Platform
- Emailing team@ejarmate.com with details of the violation
- Contacting our support team through the Platform messaging system
All reports are investigated promptly and confidentially.
4. Payments and Billing
Service Fees
Ejarmate may charge fees for certain services, which will be clearly disclosed before you complete any transaction. Current services that may incur fees include:
- Premium membership features (if applicable)
- Verified profile boost or priority listings
- Additional reference verification
- Transaction processing fees
All fees are non-refundable unless otherwise specified in this agreement or as required by law.
Payment Methods
Ejarmate accepts the following payment methods in Saudi Arabia:
- Mada (Saudi Arabian debit and credit cards)
- STC Pay (Mobile payment service)
- Apple Pay (for iOS users)
- Bank Transfer (for landlords and institutional payments)
All payments must be made in Saudi Arabian Riyal (SAR) unless otherwise indicated.
Payment Processing
When you submit payment information:
- You authorize Ejarmate to charge your payment method for the agreed amount
- You confirm that you are authorized to use the payment method provided
- You represent that the payment information is accurate and current
- Payment processing is subject to our payment processor's terms and conditions
Ejarmate does not store credit card information directly; all payments are processed through secure, PCI-DSS compliant payment gateways.
Billing Cycles
For subscription-based services (if offered):
- Billing cycles will be clearly specified before subscription
- Recurring charges will occur on the date specified in your billing information
- You will receive billing confirmations via email
- You can cancel subscription services at any time through your account settings
Cancellation of subscriptions takes effect at the end of the current billing cycle. No refunds will be issued for partial periods.
Failed Payments
- Ejarmate will attempt to process the payment again
- If payment fails after multiple attempts, your account access may be suspended
- Outstanding balances may result in account termination
You are responsible for maintaining current and valid payment information.
Refund Policy
Refunds are generally not permitted for services already rendered. However, Ejarmate may issue refunds in the following circumstances:
- Duplicate charges due to Platform error
- Services not provided as advertised
- Fraudulent charges on your account
- As required by Saudi Arabian law or consumer protection regulations
Refund requests must be submitted within 30 days of the transaction. Ejarmate will investigate and respond within 7-10 business days. Approved refunds will be processed to the original payment method within 5-7 business days.
Currency and Taxes
All prices are displayed in Saudi Arabian Riyal (SAR). You are responsible for any taxes, duties, or government fees associated with your use of Ejarmate. Ejarmate will charge and remit applicable Value Added Tax (VAT) as required by Saudi Arabian law.
5. Intellectual Property Rights
Platform Ownership
Ejarmate and all content on the Platform, including software, design, text, graphics, logos, images, and compilation of information (collectively, "Platform Content"), are the exclusive property of Ejarmate or our licensors. All intellectual property rights are reserved.
You may not reproduce, distribute, transmit, modify, or create derivative works of Platform Content without our express written permission.
User Content License
By uploading profile information, photos, messages, reviews, or other content to Ejarmate ("User Content"), you grant Ejarmate a worldwide, non-exclusive, royalty-free, perpetual license to:
- Store and display your User Content
- Use your content for moderation, safety, and fraud prevention
- Improve our Platform and services
- Display aggregate or anonymized data from your content
You retain ownership of your User Content and can request deletion at any time.
Restrictions on Use
- Remove or alter any copyright, trademark, or proprietary notices
- Attempt to decompile, reverse engineer, or hack the Platform
- Use Platform Content for unauthorized commercial purposes
- Reproduce, distribute, or transmit any material for profit without permission
- Create derivative works based on Platform Content
Violations of these intellectual property rights will result in immediate account termination and potential legal action.
6. Modifications to Service
Right to Modify
Ejarmate reserves the right to:
- Modify, suspend, or discontinue any feature or service at any time
- Add, remove, or change functionality on the Platform
- Change pricing, fees, or billing terms
- Implement new policies or requirements
- Update the verification process or safety standards
Notification of Changes
For significant changes to services, pricing, or policies, Ejarmate will provide notification through:
- Email to your registered email address
- Prominent notice on the Platform
- In-app notifications or pop-up alerts
Minor updates and technical improvements may be implemented without advance notice.
Continued Use
Your continued use of Ejarmate following notification of changes constitutes your acceptance of the modified terms. If you do not accept changes, you have the right to discontinue your account within 30 days of notification.
Service Interruption
Ejarmate may interrupt service for:
- Maintenance and system updates
- Technical issues or system failures
- Security incidents or data breaches
- Legal obligations or government requests
- Force majeure events beyond our reasonable control
We will attempt to minimize service interruptions and will not be liable for damages resulting from temporary unavailability.
7. Limitation of Liability
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY SAUDI ARABIAN LAW, EJARMATE PROVIDES THE PLATFORM ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT OF THIRD-PARTY RIGHTS
- ACCURACY, COMPLETENESS, OR RELIABILITY OF CONTENT
- ABSENCE OF VIRUSES, MALWARE, OR HARMFUL CODE
- UNINTERRUPTED OR ERROR-FREE SERVICE
EJARMATE DOES NOT WARRANT THAT:
- THE PLATFORM WILL MEET YOUR SPECIFIC REQUIREMENTS
- THE PLATFORM WILL BE SECURE, SAFE, OR FREE FROM ERRORS
- THE MATCHING ALGORITHM WILL PRODUCE COMPATIBLE MATCHES
- ROOMMATES OR LANDLORDS WILL BE HONEST, TRUSTWORTHY, OR LEGITIMATE
- RENTAL TRANSACTIONS WILL BE COMPLETED SUCCESSFULLY
Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EJARMATE SHALL NOT BE LIABLE FOR:
- Direct Damages: Loss of data, money, or profits
- Indirect Damages: Consequential, incidental, special, or punitive damages
- Loss of Use: Inability to use the Platform or services
- Lost Revenue: Loss of business income or earning potential
- Relationship Damage: Conflicts with roommates, landlords, or other users
- Housing-Related Losses: Homelessness, eviction, or unsuitable living conditions
- Fraudulent User Actions: Scams, theft, or deception by other users
TOTAL LIABILITY: Regardless of the cause, Ejarmate's total liability to you shall not exceed the amount you paid to Ejarmate in the 12 months preceding the claim.
Exceptions
- Personal injury or death caused by Ejarmate's gross negligence
- Fraudulent conduct by Ejarmate
- Violations of your rights as a consumer protected by Saudi Arabian law
- Statutory obligations that cannot be limited or excluded
User Responsibility
By using Ejarmate, you assume all risks associated with:
- Communicating with other users
- Meeting roommates or landlords in person
- Sharing personal information with other users
- Entering into rental agreements or contracts
- Housing situations and living arrangements
Ejarmate strongly recommends that you:
- Verify the identity and background of roommates and landlords through multiple sources
- Meet in safe, public locations
- Conduct property viewings with a trusted companion
- Review contracts carefully before signing
- Use official legal channels for rental agreements
8. Indemnification
You agree to indemnify, defend, and hold harmless Ejarmate, its founders, employees, contractors, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:
- Your violation of these Terms of Service
- Your violation of applicable laws or regulations
- Your User Content or information provided on the Platform
- Your conduct or interactions with other users
- Your use of the Platform for unauthorized purposes
- Any claims by third parties regarding your actions on Ejarmate
Ejarmate reserves the right to assume the defense of any claim at your expense.
9. Dispute Resolution
Informal Resolution
Before initiating formal dispute resolution, users and Ejarmate agree to attempt informal resolution by:
- Contacting our support team at team@ejarmate.com
- Providing detailed documentation of the dispute
- Engaging in good-faith negotiation for 30 days
Formal Dispute Resolution
If informal resolution is unsuccessful, disputes shall be resolved through:
- Mediation: Parties agree to attempt mediation through a mutually agreed mediator
- Arbitration: If mediation fails, disputes shall be submitted to binding arbitration under Saudi Arabian arbitration laws
- Court Jurisdiction: Unresolved disputes shall be subject to the exclusive jurisdiction of the courts in Saudi Arabia
Class Action Waiver
Both parties agree to resolve disputes individually and waive the right to pursue class action lawsuits or collective proceedings against Ejarmate. Disputes must be brought in the name of the individual user only.
10. Governing Law and Jurisdiction
Applicable Law
These Terms of Service are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of laws principles.
Jurisdiction
Both parties submit to the exclusive jurisdiction of the Saudi Arabian courts for any legal proceedings arising from these terms. You agree not to pursue legal action in any other jurisdiction.
Legal Compliance
Ejarmate complies with all applicable Saudi Arabian laws and regulations, including:
- The Personal Data Protection Law (PDPL)
- The Saudi General Authority for Competition (GAC) regulations
- The Saudi Central Bank and Monetary Authority (SAMA) requirements
- Anti-corruption and anti-bribery laws
- Consumer protection regulations
- Ejar system requirements for rental registration
11. Termination
Termination by User
You may terminate these Terms of Service and your account by:
- Requesting account deletion through account settings
- Emailing team@ejarmate.com with your account ID and deletion request
- Providing written notice to our registered address
Termination is effective immediately upon request. No refunds will be issued for any pre-paid services or fees.
Termination by Ejarmate
Ejarmate may terminate your access to the Platform and these Terms of Service at any time, with or without cause, including:
- Violations of these Terms of Service
- Illegal or harmful activities
- Safety concerns
- Non-payment of outstanding fees
- Inactivity for an extended period (more than 12 months)
Termination by Ejarmate is effective immediately and is final. Terminated users may not create new accounts.
Effect of Termination
- Your account and all associated data will be deleted or archived
- You lose all access to the Platform
- You forfeit any pending transactions or credits
- You remain liable for any outstanding fees or obligations
- Provisions that survive termination (Limitation of Liability, Governing Law, Indemnification) remain in effect
12. Third-Party Links and Content
External Links
Ejarmate may contain links to external websites and resources operated by third parties. We are not responsible for:
- The content, accuracy, or legality of external websites
- The privacy practices or terms of service of third parties
- Any loss, damage, or harm resulting from your use of external websites
Third-Party Services
Ejarmate integrates with third-party services, including:
- Absher (Saudi government verification system)
- Payment processors (Mada, STC Pay, Apple Pay)
- Cloud hosting providers
- Analytics services
Use of third-party services is subject to their terms of service and privacy policies. Ejarmate is not liable for any issues arising from third-party services.
Third-Party Content
User-generated content on Ejarmate, including profiles, messages, and reviews, represents the views of individual users and not Ejarmate. We do not endorse or verify the accuracy of user-generated content.
13. Severability and Entire Agreement
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, severed from these terms. The remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms of Service, along with our Privacy Policy and any other posted policies, constitute the entire agreement between you and Ejarmate regarding your use of the Platform. These terms supersede all prior agreements, understandings, and communications between the parties.
No Waiver
Ejarmate's failure to enforce any provision of these Terms of Service shall not constitute a waiver of that provision or any other provision.
